Learned Senior advocate appearing for the petitioner submits that, there was inordinate and unexplained delay in lodging First Information Report from the date of incident. Moreover, he highlights the fact that the statement recorded under Section 164 also does not explain the delay of lodging of the First Information Report.

Learned advocate appearing for the State draws the attention of the Court to the earlier order dated July 19, 2021. He also relies upon the contents of the case diary. Considering the fact that the earlier application of the petitioner was rejected on July 19, 2021 and considering the fact that there is hardly any material change in the

circumstances and considering the materials in the case diary, we are unable to grant bail to the petitioner. Accordingly, prayer for bail is rejected and the application being CRM 6207 of 2021 is disposed of. (Debangsu Basak, J.) (Ananda Kumar Mukherjee, J.)
