Maimood Khan v. State Of West Bengal & ANR.
31.10.2022 Item no.34.
Court No.35.
I.T C.R.R 1852 of 2015 Maimood Khan -Vs.- State of West Bengal & Anr.
None appear on behalf of either parties when the matter is called on today.
It is evident that the present case is appearing in the list from 6th September 2022 and has been called on every day since thereafter when neither of the parties were ever represented. Hence today the matter is taken up for disposal on merit in absence of the parties.
The criminal proceeding arising out of Contai P.S Case No.162 dated 23.04.2015 under Sections 409/419/468 of IPC AND 93(6)/93(7)/93(4) (d)/93(4)(e) of the West Bengal Valuation Added Tax Act, 2003 ( being G.R. Case No.628 of 2015) is under challenge in this revision which the petitioner has stated to have been initiated against him only maliciously and motivatedly. The petitioner had prayed for quashing of the entire proceedings as mentioned above.
The grounds pleaded by the petitioner appear to be not sufficient and cogent to ensure an order as prayed for him. Hence petitioner's prayer as above is found to be meritless.
Accordingly on the finding as above the present revision case being CRR 1852 of 2015 is dismissed.
Interim order, if any, stands vacated.
