Learned advocate appearing for the petitioner is aggrieved by the fact that the police authorities did not incorporate appropriate provisions of law, inspite of a direction passed under Section 156(3) of the Code of Criminal Procedure by the learned Judicial Magistrate. Petitioner is also aggrieved regarding the mode and manner of investigation.

State has submitted a report. Report reflects that investigation in respect of Chandannagar Police Station Case no. 88/24 dated 07.06.2024 is progressing. However the accused person Ranjit Das could not be traced. Learned advocate for the State has also submitted that there has been a lack of communication between the petitioner who is the de facto complainant and the investigating agency. It has been submitted that in case the de facto complainant communicates with the

investigation of the case, remedies sought for by the petitioner would be addressed in accordance with law. Learned advocate for the petitioner undertakes that the petitioner would meet the investigating officer of the case. Police authorities are directed that they would if require again record the statements under Section 161 of the Code of Criminal Procedure and if they filed certain suitable alterations are required the same be done in accordance with law.

With the aforesaid observations WPA 15321 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
