Mr. Sengupta, learned advocate for the alleged contemnor hands over documents in order to show that the Executive Engineer, Tamluk Highway Division has taken steps under Section 10(2) of the West Bengal Highway Act, 1964 and the matter is now pending before the SubDivisional Executive Magistrate, Egra. It appears that the allegations of the petitioners regarding unauthorized construction of P.W.D. road are treated to be correct and the authority has proceeded for orders of eviction.

None appears on behalf of the petitioners. It appears to the Court that the petitioners have lost interest in the matter. On the last occasion also the petitioners did not appear.

Accordingly, the contempt application is dismissed for default.
