Affidavit-of-service filed in Court today be taken on record.
The petitioner has obtained a decree from the Additional District Judge, 4th Court, Midnapore on 2nd June, 1987 in Title Appeal No. 420 of 1986. By the said decree, the private respondents have been restrained from in any way interfering with the petitioner's use of the said land in question. Despite the said decree, the private respondents are continuing to disturb the petitioner. The petitioner has addressed a complaint from 2016 onwards until 2018 to the Belda Police Station.
In view of the aforesaid, the Officer-in-charge, Belda Police Station shall ensure that the petitioner is not disturbed by the private respondents. Belda Police Station shall post a police picket on the disputed land at the costs of the petitioner for a period of two weeks from the date of deposit of costs.
The private respondents shall also be restrained from in any way disturbing the peaceful possession and use of the land.
With the aforesaid directions, the instant writ petition shall stand disposed of.
There will be no order as to costs.
