For the NIC/UOI The learned advocate for the petitioner has taken instruction in terms of the observation made in the order dated 4th August, 2022. The post of Librarian in Malda Town High School will fall vacant on and from 1st September, 2022. The petitioner is willing to join thereat. The qualification of the petitioner, as indicated by the State respondents, matches the required qualification for the post of Librarian in Malda Town High School. In the aforesaid facts and circumstances, the respondents and in particular the respondent nos. 5 and 6 shall see that the petitioner's name is recommended for being appointed as Librarian in Malda Town High School and the petitioner is so appointed thereat in terms of the recommendation by 15th September, 2022.

The respondents shall also ensure that no one else is appointed in the post of Librarian in Malda Town High School immediately after the same falls vacant with effect from 1st September, 2022 till the petitioner is appointed thereat.

All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court, without insisting upon production of certified copy thereof.

Nothing further remains to be adjudicated in this writ petition. The same is disposed of accordingly without any order as to costs.

Since I have not called for any affidavits, allegations made in the writ petition are deemed to have not been admitted by the respondents.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of necessary formalities.
