The order impugned being an order under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure is appealable under Order XLIII Rule 1(r) thereof, as such, the revisional application is not maintainable.

C.O. 2053 of 2024 is dismissed as such without any order as to costs.

It is made clear that this order, however, will not prevent the petitioner to challenge the same before the appropriate forum of law in accordance with law. Liberty is granted to the learned Advocate-onrecord for the petitioner to take back the certified copy of the impugned order upon furnishing a photocopy thereof.
