04.04.2023 Court : 35 Item : 30 Matter : CRR Status : OP Bench ID : 266010 Transcriber : NANDY CRR 2015 of 2016 Madhusudan Singh Vs.

The State of West Bengal The matter is pending for a pretty long time and since 23.02.2023 the same has been called on everyday working of this Court, though none appeared on any occasion.

None appears on behalf of either of the parties in spite of the matter being called on for the second time today. Since the matter pertaining to the year 2016, it would not be proper to waste any further time and the same is taken up in absence of the parties. This is a case in which the petitioner has prayed for quashing of the Parulia Coastal Police Station (South 24-Parganas) First Information Report No. 3 of 2016 dated 12.01.2016 filed under Sections 255/261/ 409/406/467/468/471 of the Indian Penal Code. The petitioner has pleaded the ground that the FIR would not reveal any cognizable offence to him to justify a criminal proceeding in the Trial Court. He has prayed for quashing of the FIR.

On careful perusal of the record and the annexed documents, the grounds pleaded by the petitioner do not appear to be cogent enough to warrant interference of his Court into the said proceeding. Hence this matter does not appear to have any merit and is liable to be dismissed. CRR 2015 of 2016 accordingly stands dismissed. Connected applications are also disposed of.
