Referring to complaint dated December 28, 2023, Annexure p-1 at page 9 to the writ petition, learned counsel for the petitioner submits that, pursuant to the said complaint necessary enquiry has already been held on June 20, 2024 at the Society. In support of his contention he has handed over a communication dated June 14, 2024 issued by the jurisdictional inspector of Co-operative Societies, the same is taken on record.

The grievance of the petitioner is that, the enquiry report has not yet been furnished before the Cooperative Society and the petitioner. Mr. Sureka, learned counsel appearing for the respondent nos. 1 & 2 submits that, if the enquiry has been conducted and completed the report shall be made over to the Co-operative Society and the petitioner within a short while.

In view of the above, the respondent no. 2 is directed to furnish copies of the report to the Cooperative Society and to the petitioner positively within a period of three weeks from the date of communication of this order.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations and directions, this writ petition, WPA 15316 of 2024 stands disposed of, without any order as to costs.

Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
