Petitioner has approached the Executive Magistrate and thereafter wants return of the shop room.

State has submitted a report. Report reflects that pursuant to informations furnished by the respondent no. 5, two criminal cases have been registered by Kasba Police Station being Kasba PS Case No. 49 dated 05.02.2024 and Kasba PS Case No. 293 dated 25.07.2024.

Having considered the prayer which has been advanced by the petitioner, I am of the view that such prayer cannot be entertained by the writ court while exercising the jurisdiction under Article 226 of the Constitution of India. Petitioner will

approach the jurisdictional civil court for the nature of relief claimed by him.

With the aforesaid observations WPA 14165 of 2025 is disposed of.

Report submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
