The petitioner's challenge was initially to the alleged inaction by the Bank in not acting upon the request of the petitioner to redeem the mortgage. 2.

Learned counsel appearing for the Bank submits that, in the meantime, the sale has been effected and sale certificate issued.

Thus, the writ petition has become infructuous. 4.

Accordingly, W.P.A. No. 14311 of 2023 is disposed of by directing the Bank to deduct the amount due to the Bank in lieu of the loan and to refund the balance amount from the sale proceeds in consonance with law to the petitioner at the earliest thereafter.

It is expected that the entire exercise shall be concluded by November 30, 2023.

There will be no order as to costs.
