Petitioner is presently working as Group-C employee of Purba Bardhaman Zila Regulated Market Committee.

It is submitted by the learned advocate representing the petitioner that at the material point of time petitioner was appointed on substantive basis as Market Worker (Group-D) employee in Katwa Regulated Market Committee vide memo dated 8th July, 1996. Petitioner worked as Group-D employee till 31st January, 2024 and thereafter was promoted to Group-C post being Market Assistant.

Petitioner prays for direction for his promotion from Group-C to Group-B post and it is further submitted

that posts are available against one of which petitioner can be promoted.

It is also submitted that petitioner has completed one year service as Group-C employee with effect from 1st February, 2024. In this regard a representation has been made on 8th May, 2025 by the petitioner addressed to the District Magistrate, Purba Bardhaman & Chairman, Purba Bardhaman Zila Regulated Market Committee being respondent no.3.

Learned advocate representing Secretary, Purba Bardhaman Zila Regulated Market Committee being respondent no.4 submits that no posts are available against which petitioner can be promoted from Group-C to Group-B.

State respondents are also represented by learned advocates.

Having considered the case made out in this writ petition, Court finds no purpose would be sub-served in keeping this writ petition pending.

Respondent no.3 is directed to consider the representation of the petitioner dated 8th May, 2025 by six (6) weeks from the date of communication of this order and a reasoned order shall be passed after

granting opportunity of hearing to the petitioner, respondent no.4 or their representative. Decision to be taken by respondent no.3 shall be communicated to the petitioner by seven (7) days thereafter. 10.

With the above directions writ petition stands disposed of.

Since no affidavits are called for, allegations contained in the writ petition are deemed not to have been admitted.

Learned advocate for the petitioner is directed to communicate this order enclosing representation dated 8th May, 2025 to the respondent no.3 at an early date.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
