Mr. Ekramul Bari, Sk. Imtiaj Uddin .... For the petitioner The petitioner is represented and none on behalf of the respondents are present in Court, when the matter is called on.

It appears from the record that in spite of directions for filing affidavit-inopposition, respondents have not chosen to comply with the said order.

Eventually, the respondents are found not to be interested in pursuing this matter any further. The same is taken up for delivery of order, in absence of the respondents. Petitioner has an innocuous prayer for an order directing the respondent authorities to consider

his representation dated February 6, 2009 (Annexure P-III). The matter relates to his prayer for grant of enhanced scale of pay, in view of his upgraded, post-graduate qualification.

According to the petitioner vide Memo dated February 12, 1999, the School Education Department , Government of West Bengal introduced revised scale of pay for a suitable candidate having higher qualification. Petitioner says that he is entitled to be benefitted under the said direction. As he has not been granted the benefit under the same memo issued by the authorities, he has made the representation, as mentioned above, for due consideration, which has remained unattended till date.

Learned advocate appearing for the petitioner submits that since the previous representation was submitted back in the year 2009, his client will be desirous to submit a comprehensive fresh representation, which may be directed to be heard along with the representation dated February 6, 2009.

Permission is granted.

The respondent authoritie/s shall consider petitioner's representation dated February, 6, 2009 along with a fresh comprehensive representation submitted by him, if any, within a period of four weeks from the date of this order, after affording an opportunity of hearing to the petitioner.

The writ petition is thus allowed and disposed of.
