For the State The petitioner is aggrieved with the fact that in spite of informing the Officer in Charge, Beniapukur Police Station on or about 16th February, 2024, no steps have been taken till date.

The grievance of the petitioner is that the private respondent is adamant in his illegal activities and as such has been disturbing the possession of the petitioner in his shop room as also throwing out the goods therefrom which led the petitioner to close down the shop.

Learned counsel for the State submits that the incident is of 20th February, 2023. However, the representation was made to the police authorities almost after a year thereafter.

Having considered the fact that the petitioner still complains of his shop being closed down by the acts and action of the private respondent, I direct that the petitioner would file a fresh representation before the police authorities or in the alternative to the

jurisdictional Magistrate under the relevant provisions of law.

Learned Magistrate shall assess and ascertain the said allegations and pass necessary directions as he may deem fit and proper.

With the aforesaid observations, the writ petition being W.P.A. 15323 of 2024 is disposed of.
