Mr. Indrajit Dasgupta, learned Counsel representing the alleged contemnors has submitted that the alleged Contemnor No.2 had retired on 31st March, 2022 and the new incumbent has initiated the process of implementing the order dated 6th August, 2021.

Sri S. Raju, who joined as Director General, Geological Survey of India is added as the alleged contemnor No.5 in the contempt application.

A communication from Sri Rajendra Prasad, Deputy Director (P&A) & OIC (Law) for Additional Director General & HOD, Geological Survey of India dated 4th May, 2022 is produced before us wherefrom it appears that the competent authority of Geological Survey of India has decided to implement the order dated 6th August, 2021. Admittedly, there is no compliance as on date.

Sri Rajendra Prasad, Deputy Director (P&A) & OIC (Law), Geological Survey of India, who issued the letter dated 4th May, 2022 is also added as alleged contemnor No.6 in the contempt application.

Accordingly, we direct the department to issue rule against the alleged contemnors, namely, Shri S. Raju, the Director General, Geological Survey of India and Sri Rajendra Prasad, Deputy Director (P&A) & OIC (Law), Geological Survey of India.

The pendency of this contempt application shall not preclude the alleged contemnors to comply with our order dated 6th August, 2021.

The rule is made returnable on 19th May, 2022 at 1.00 p.m.

An affidavit of compliance shall be filed on the adjourned date.
