The writ petitioners have prayed for an order upon the competent authority of the Kolkata Municipal Corporation to dispose of the application dated August 10, 2021. The said application relates to a prayer for regularisation of certain unauthorised construction in respect of premises no. 4/2H/14/1, Bhukailash Road, Khiddirpur, Kolkata 700 023.

Mr. Chatterjee, learned advocate for the Kolkata Municipal Corporation submits that the application shall be disposed of in accordance with law but the prayer for disposal of the said application the Special Officer (Building) will have to decide the issue. Under such circumstances, this writ petition is disposed of with a direction upon the competent authority of the Kolkata Municipal Corporation to refer the matter to the Special Officer (Building) and the

same shall be disposed of upon hearing the petitioner and any other interested parties.

reasoned order shall be passed and communicated to all concerned.

The entire exercise shall be completed within a period of four months from the date of communication of this order.

The writ petition is disposed of.

There will be, however, no order as to costs. Parties are directed to act on the basis of the server copy of this order.
