1. Learned counsel for the petitioner seeks to withdraw the present writ petition since a final order dated 15.5.2024 has been passed by the corporation in regard to the premises situated at 77 Metcalfe Street PS Bowbazar Ward no. 46 Kolkata 700013 under section 412A(i) of the Kolkata Municipal Corporation Act 1980.

2. Copy of the order passed under section 412A(i) of the Kolkata Municipal Corporation Act 1980 is taken on record.

3. Petitioner is at liberty to take appropriate remedies available in accordance with law.

4. In view of above, present writ petition is dismissed as withdrawn.

5. In the meantime, the order dated 15.5.2024 shall remain stayed till 08.04.2025 to enable the petitioner to challenge the order dated 15.05.2024.

6. If the petitioner fails to challenge the same within the stipulated time, the stay stands vacated.

7. It is clarified that this Court has not examined the merit of the case.
