Heard learned Advocates appearing for the parties. Petitioner has filed this writ petition being aggrieved by the alleged inaction on the part of the respondents/Electricity authority concerned in providing electricity connection to the petitioner in spite of fulfillment of all the criteria under the law. Learned Advocate appearing for the respondents/Electricity authority concerned submits that the authority could not provide electricity connection to the petitioner due to physical obstruction and resistance by the private respondents by raising the dispute over the premises in question through which electricity cables have to be laid down and submits that in such circumstances appropriate authority is the District Magistrate concerned for resolving the issue between the petitioner and the private respondents, under Rule 3 of the Works of Licensees Rules, 2006. Considering the facts and circumstances of the case and submission of the parties, this writ petition being

WPA 14322 of 2023, is disposed of by directing the respondents/Electricity authority concerned to refer the case of the petitioner before the District Magistrate concerned, within a period of three weeks from date with proper intimation to the petitioner and the District Magistrate concerned shall take a decision within four weeks from the date of receipt of such reference from the Electricity authority concerned, after giving an opportunity of hearing to the interested parties.
