Learned advocate appearing for the petitioners 08.07.2025 Court No. 35 Item No.09 Rakib submit that by depriving the petitioner the co-sharers have transferred/sold the property and the same is with the aid of forged and fake documents.

Learned advocate appearing for the State has submitted a report. Report reflects that the police authorities conducted an enquiry and found that there were certain title deeds which were in possession of the private respondents. The property has been transferred to M/s. I-Nova Real Estate Pvt. Ltd. Prima facie police authorities did not find any cognizable offence and also recorded that the dispute is an intra family property dispute of more than 16 years.

Having considered the report which has been submitted and the petitioner insisting that there were forged and fake documents by way of which the property has been transferred, I grant liberty to the petitioner to

approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would assess and ascertain regarding the genuinity of the accusations and thereafter pass necessary orders as he deems fit and proper.

With the aforesaid observations WPA 14184 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
