2. State is represented.

3. In compliance with the earlier direction passed by this Court. Report was submitted by the Superintendent of Police, Raiganj, Police District, Uttar Dinajpur, indicating that all the appellants have expired during the pendency of this appeal. It is stated in the said report that the Enquiry Officer could not collect the death certificates of the appellants. However, he collected certificate to that effect issued by the concerned Pradhan of the Gram Panchayat. The said certificate issued by the Durlovpur Gram Panchayat states that appellants, Nilkanta Barman @ Dhatra Barman, Jogen Barman and Niren Barman have expired. The certificate issued by the Gram Panchayat is tagged with the report submitted by the Superintendant of Police, Raigunj Police District, Uttar Dinajpur.

4. As all the appellants have expired the instant appeal is abated against them.

5. Accordingly, the instant appeal being CRA 395 of 2001 is hereby dismissed as abated.
