Mr. Biswarup Biswas, Mr. Kamal Mishra, Mr. Pratap Sanfui .......for the petitioner Mr. Sourav Mitra, Mr. Suman Dey ..for the WBCSSC The petitioner's application for transfer on medical ground was forwarded by the HOI to the District Inspector of Schools (SE), Malda. The D.I., in turn, sought opinion of the CMOH at Chanchal SSH, Malda. The application is pending reference since March 28, 2022.

In that view of the matter, the Superintendent of Chanchal SSH, shall within a period of one week from date send the medical opinion of the petitioner along with all 17 others appended to the list of the communication dated March 28, 2022 of the CMOH at Jhaljhalia, Malda, if not already sent.

The aforesaid time frame shall be strictly and diligently followed by the Superintendent, Chanchal SSH.

Upon receipt of the petitioner's medical report, the D.I. shall act strictly in terms of the Rules and process the petitioner's application as expeditiously as possible and in accordance with law.

The petitioner's application that has been returned by the D.I. pending receipt of a copy of the medical report from the Superintendent, Chanchal SSH, shall be returned back by the HOI to the DI immediately upon receipt of a copy of this order.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
