The petitioner has filed the present writ application praying for an order directing the respondent no. 1 to take appropriate action including but not limited to initiation of insolvency or winding up proceedings against the respondent no. 2 in view of the inaction by respondent no. 1 and the loan default committed by respondent no. 2.

2. The Reserve Bank of India has submitted report wherein it is mentioned that the total asset size of the respondent no. 2 was Rs. 283.66 crore as per return filed by the RBI on March 31, 2024. The RBI has also disclosed the balance sheet of the Riddhi Portfolio Private Limited which corroborates the statement made in the paragraph no. 19 of the report filed by the RBI.

3. Learned counsel for the petitioner submits that after considering the report of the RBI and the balance sheet,

the petitioner is not intending to proceed with the present writ application with the liberty to take appropriate steps in accordance with law.

4. In view of the above, the writ petition is disposed of with the liberty to the petitioner to take appropriate steps in accordance with law before appropriate authority.

5. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
