Anesh Sikh Ms. Shila Sarkar .....For them appellant/petitioner Learned Advocate-on-record appearing on behalf of the appellant submits that the dispute between the parties has been settled amicably out side the court. In terms of the said settlement the appellant does not want to proceed with this matter further.

Having heard learned counsel for the appellant and considering the written instruction, let the second appeal be and the same is hereby dismissed as not pressed.

Interim order, if any, passed by this court during the pendency of the second appeal is hereby vacated.

Trial court record, if received, be sent down atonce to the trial court through Special Messenger cost to be borne by the appellant.
