Heard the learned Counsel for both the parties. 2.

275 bottles of phensedyl having been seized from the possession of the petitioner and other three co-accused persons and in view of the bar under Section 37 of the NDPS Act, we are not inclined to exercise our discretion in favour of the petitioner under Section 439 Cr.P.C at this stage. 3.

Accordingly, the prayer for bail of the petitioner is rejected. 6.

CRM (NDPS) 1168 of 2023 is dismissed.
