The defendant in a suit for Ejectment is the petitioner of the instant application under Article 227 of the Constitution of India which is directed against order dated June 03, 2024 passed by the 1st Court of the learned Civil Judge (Junior Division) at Sealdah, District : 24-Parganas (South) in the said suit being Ejectment Suit No.14 of 2017.

The learned Trial Judge by the order impugned had rejected the prayer of the petitioner for adjournment and closed the evidence of D.W.2.

The suit is pending since 2017. The witness action of the suit was started long after seven years of filing, in the year 2024. The evidence of D.W.1 was started on May 04, 2024 and was concluded on May 22, 2024.

This is a simple suit for Ejectment where one witness has already been examined on behalf of the defendant. In view of the nature of the suit and long pendency of it, this Court is not inclined to interfere with the order impugned. C.O. 2059 of 2024 is dismissed without any order as to costs.
