2) Petitioner being an Assistant Teacher made application for transfer on Utshasree portal on 21st November, 2022 since he is suffering from Locomotor disability of limbs. Relying on Disability Certificate dated 25th July, 2024 it is submitted that petitioner is suffering from eighty percent disability which was assessed at seventy-five percent when application was made for transfer on 21st November, 2022. On perusal of the document at page 85 of the writ petition, it appears that school authority where petitioner is presently working forwarded the transfer application through portal on 2nd December, 2022 to the

concerned District Inspector of Schools and District Inspector of Schools subsequently forwarded transfer application on 2nd December, 2022 to West Bengal Central School Service Commission. Grievance of the petitioner is till date transfer application of the petitioner has not been decided.

3) West Bengal Central School Service Commission is represented by learned advocate who has submitted that in the event direction is given concerned authority of the Commission shall decide the transfer application in accordance with law.

4) Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing Chairman of West Bengal Central School Service Commission being respondent no. 4 to decide transfer application in accordance with law within a period of four weeks from date of communication of this order and decision to be taken by respondent no. 4 shall be communicated to the petitioner by fortnight thereafter.

5) However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.

6) There shall be no order as to costs.

7) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
