Learned advocate representing the petitioner submits that in terms of the direction passed by the Court on June 16, 2023, out of 62 candidates 41 candidates were permitted to file their nominations; out of which nominations stood rejected and candidates could not file the Form-'B'.

Learned advocate for the petitioner submits that 21 candidates who submitted their nominations in respect of Sandeshkhali Block-1 be permitted to file the Form-'B'.

Learned advocate representing the State Election Commission has obtained instruction from the Panchayat Returning Officer and the Sub-Divisional Officer, Basirhat, North 24 Parganas signed on June 19, 2023 that the number of DCR booked were 38, but the total nominations filed were 35, out of which 21 nominations were filed from the Sandeshkhali Block-1. The respondent authority permitted the candidates to deposit the amount and obtain the DCR till 4 p.m. It took approximately four hours to complete the receiving process and the final count of receiving nominations came to 35.

As it appears that the direction of the Court has been substantially acted upon, accordingly, there is no requirement of proceeding with the writ petition any further.

The writ petition stands disposed.

Instruction given by the respondent authority be retained with the records.
