The petitioner claims to be the son of one Abinash Chandra Maity who was a Primary School Teacher. He retired from service on 3rd June, 1975 and expired on 8th September, 1979. The widow of the teacher expired on 30th April, 2013.
The petitioner seeks benefit in terms of the Government Order being No.539-SE(80)-(P7B) dated 1st November, 2010.
A representation was made by the petitioner before the District Inspector of Schools (PE), Purba Medinipur in February, 2023 seeking relief in terms of the aforesaid notification, but the same is alleged to be kept pending.
Learned advocate representing the State respondent has obtained instruction from the District Inspector of Schools, Primary Education, Purba Medinipur dated 29th July, 2024 which mentions that for processing the prayer of the petitioner certain documents are required.
It appears that the petitioner is yet to be intimated about the documents that are required for processing his case. A copy of the communicating memo dated 29th July, 2024 has been handed over to the learned advocate for the petitioner. The petitioner is directed to take steps for forwarding the documents as sought for.
The District Inspector of Schools is directed to take steps and act in terms of the aforesaid memo on receipt of the documents from the petitioner. If the petitioner is found entitled to the benefit, the same shall be disbursed in his favour at the earliest, but, positively within a period of eight weeks from the date of submission of all documents. The writ petition stands disposed of.
Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
