The petitioner challenges the action of the bank in not replying to his notice under Section 13(3) of the Securitization and Reconstruction of the Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as the SARFAESI Act), and initiating proceeding under Section 14 of the SARFAESI Act. The application under Section 14 of the Act has also been disposed of by the respondent No.4 passing an order thereon on April 24, 2025.

The challenge to the order of the respondent No.4 and also any challenge to the acts of commission and/or omission of the respondent Bank are within the exclusive domain of a Tribunal, which has been instituted for this purpose alone.

Thus, the petitioner having an alternative and efficacious remedy to redress his grievances, I am not inclined to entertain the writ petition 5.

Accordingly, the writ petition is dismissed.

6. There shall be no order as to costs.
