The petitioner has assailed the order passed by the learned Additional District & Sessions Judge, 4th Court, Malda cum Special Court under NDPS Act on May 3, 2024 in NDPS case no. 111 of 2021 issuing warrant of proclamation and attachment against the petitioner fixing 13th June, 2024 for appearance and execution return of the proclamation. Learned counsel for the petitioner submits that the statutory period of thirty days after issuance of the proclamation was not granted to him prior to the execution of the proclamation.

It appears that the proclamation was issued on 3rd May, 2024 fixing 13th June, 2024 for appearance and execution return of the proclamation. The proclamation was directed to be executed on 13th June, 2024 and in fact executed on 24th June, 2024.

In view of the above, this Court finds no illegality in such order or compliance thereof and as such, the revisional

application, being CRR 2323 of 2024 is dismissed as redundant.
