The petitioners seek expeditious disposal of the proceedings of G.R.Case No. 1075 of 2016 pending pending before the learned Metropolitan Magistrate, 15th Court, Calcutta. It appears that the charge sheet was submitted on March 21, 2018 and copies supplied to the accused on September 19, 2018. The accused/ opposite parties filed an application before the learned Trial Court stating that copies of documents seized by the Investigating Officer vide a seizure list dated September 06, 2016 were not supplied to them. The prayer being turned down by the learned Trial Court, the accused/opposite parties carried the said order in a revision and by an order passed on September 27, 2019, the revisional court directed the prosecution to serve copies of the said documents to the accused persons, the said order being communicated to the learned Trial Court on October 15, 2019.

It appears that the order of the revisional court has not been complied with till date for which the matter is pending disposal.

Upon consideration of the submission made on behalf of the parties and material on record, this Court is of the view that the prosecution be directed to supply copies of documents seized vide a seizure list dated September 06, 2016 as directed by the learned revisional court within two weeks from date.

The learned Trial Court is directed to fix a date for consideration of the charge within one week from the next date fixed before him and shall dispose of the entire proceeding being G.R.Case No. 1075 of 2016 within six months thereafter without granting any unnecessary adjournment to either of the parties, in accordance with law.

On the prayer of the private opposite parties, liberty is granted to them to pray for their discharge before the learned Trial Court, in accordance with law.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
