The contention of the petitioner is that he applied for mining lease of sand before the respondent authority on March 05, 2013 and deposited requisite application fees for the same but no intimation was given to the petitioner with regard to either the application or the grant of lease by the authority. On November 10, 2020 the Additional District Magistrate and District Land and Land Reforms Officer, Bankura requested the 8th respondent to submit environmental clearance certificate in respect of the mining lease in his favour despite the petitioner having participated in the auction. The petitioner submitted a representation before the authority ventilating his grievance on January 05, 2021 which is yet to be disposed of. The petitioner prays a direction upon the respondent authority to consider the representation at the earliest. Upon consideration of the submission made by the learned counsels appearing on behalf of the parties and the material on record, the writ petition is disposed of

directing the respondent no. 3 to consider and dispose of the representation filed by the petitioner on January 05, 2021 within a period of two months from the date of communication of this order, after giving reasonable opportunity of hearing to all the affected parties including the petitioner and the private respondents, in accordance with law.

With the above observations and directions this writ petition being WPA No. 15114 of 2021 is disposed of. There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
