The 2nd Court of learned Civil Judge (Senior Division), Barasat, District-24 Parganas(North) had refused to pass an adinterim order of injunction on the application filed by the plaintiff/petitioner as the caveator was not served, however such service was effected subsequently. This Court is informed that July 24, 2024 is the next date fixed for hearing of the said application for injunction.

The petitioner is praying a direction upon the learned Trial Judge for expeditious disposal of the said application. In view of the age of the said application, the direction, as prayed for, is not warranted at this stage, however, in the event, the caveator, in spite of service, does not turn up on the next date of hearing of the said application, the plaintiff/petitioner shall be entitled to renew his prayer for an order of ad-interim injunction on the said application.

C.O. 2064 of 2024 is disposed of with the above terms without any order as to costs.
