Mr. Gangadhar Das Mr. Tanmoy Chattopadhyay ..for the petitioner Mr. Madhu Jana Mr. Rahul Agarwala ...for the State Affidavit of service filed by the petitioner is taken on record.

The Sabhapati is not represented despite service. The petitioners are members of Kaliachak II Panchayat Samity and submitted a no confidence motion against the Sabhapati of the Samity before the Prescribed Authority on June 15, 2026 which was received by the latter on the same date. Verification of the motion was completed by the Prescribed Authority on June 22, 2026 pursuant to a notice issued in respect of the same on June 16, 2026.

Learned counsel for the petitioners submits that no further step has been taken by the Prescribed Authority till date.

In view of the time frame set out under Section 101 of the West Bengal Panchayat Act, 1973, the Prescribed Authority and Sub-Divisional Officer, Malda, being the 5th respondent herein, is directed to convene the meeting within 7 days from the date of communication of this order

and take the proceedings to its logical conclusion within the time frame stipulated in the Act.

The Inspector in Charge, Mothabari Police Station, being the 9th respondent herein, is directed to render necessary assistance to the 5th respondent so that the meeting is held peacefully and without any disturbance from any corner whatsoever.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
