Learned advocate appearing for the petitioner submits that although the subject matter of the case involves 560 bottles of Phensedyl, but there has been no recovery from the possession of the petitioner and the petitioner has been implicated in connection with the instant case on the basis of the statement of the co-accused. Petitioner has been shown arrested in connection with this case since 17.12.2024. Learned advocate further submits that the investigation of the case has already been concluded as such on any stringent condition petitioner may be released on bail.

Learned advocate for the State prays and submits that there are antecedents of the petitioner wherein there were recoveries of Phensedyl.

Be that as it may, I have considered the period of detention of the present petitioner and the overall circumstances of the case. Having considered that the petitioner was only detained on the basis of statement of the co-accused, I am inclined to release the petitioner on bail. Accordingly the prayer for bail of the petitioner is allowed.

Petitioner, namely Mustakim Sk. @ Mustakin Mondal @ Mustakin Sk. shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge Special Court under NDPS Act cum Additional District Judge, 2nd Court at Berhampore, Murshidabad.

If on bail the petitioner shall be physically present on each and every date fixed by the learned Trial Court. Petitioner shall not leave the jurisdiction of District of Murshidabad without the permission of the learned Special Court. Accordingly, CRM (NDPS) 792 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
