Dr. Sutanu Kumar Patra, Sr. Advocate Mr. Saptarshi Dutt ... for the petitioner This application under Article of the Constitution of India is at the instance of the complainant praying for a direction upon the State Consumer Disputes Redressal Commission, West Bengal to dispose of Consumer Complaint Case No. SC/19/CC/894/2018 expeditiously.

Dr. Patra, learned senior advocate appearing for the petitioner submits that the complaint case is pending since the year 2018. He further submits that the opposite parties herein are not appearing before the State Commission on repeated occasions and for such reason the hearing of the complaint case has been adjourned from time to time.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties.

However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the State Commission.

From the ordersheets appended to this application this Court finds that the opposite party no.1 has not filed the brief notes of argument in spite of several dates fixed therefor. It further appears that on 28th January, 2025 the opposite parties were not present. The order dated 28th January, 2025 reflects that 14th August, 2025 has been fixed for final hearing and the parties were directed to file brief notes of argument in the meantime. The State Commission is requested to take up the complaint case for final hearing on 14th August, 2025 and to make an endeavour to dispose of the same as expeditiously as possible preferably by the end of the month of December, 2025. In the event the opposite parties do not appear on 14th August, 2025 the State Commission is directed to proceed in accordance with law.

This direction has been passed considering the fact that complaint case is pending before the State Commission from the year 2018.

With the above observations and directions, C.O. 2293 of 2025 stands disposed of.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
