IN THE HIGH COURT AT CALCUTTA

Item No.94 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 2357 of 2022 In the matter of : Pranabendu Bhattacharyya & Anr. ... Petitioners.

Mr. Subhrojyoti Bhowmick ... For the Petitioners.

Mr. Saryati Datta ... For the State.

Affidavit-of-service filed in Court today be kept on record.

I find that the investigating agency on conclusion of investigation has already submitted charge-sheet before the jurisdictional court. Records of the present revisional application reflect that a coordinate Bench of this Court was pleased to direct not to take any coercive step against the petitioners. Having regard to the fact that the coordinate Bench of this Court was primarily satisfied with the locus of the petitioners in the background of which the FIR was registered, such an interim protection was granted.

Accordingly, if the petitioners appear before the jurisdictional court, the jurisdictional court will allow the petitioners to furnish bail bonds and they may be released on bail. The quantum of bond and the conditions are to be imposed by the learned Magistrate before whom the petitioners would surrender.

So far as the issue relating to quashing of the FIR is concerned, the same is not interfered with because the FIR has already concluded in a charge-sheet which has been submitted.

Learned advocate appearing for the petitioners submits that both the petitioners are old aged and ailing persons. In view of the aforesaid, the learned trial court will not impose such stringent conditions that would interfere with the regular life of such petitioners.

No further order is passed in the present revisional application. The petitioners would be at liberty to approach this Court after obtaining the documents under Section 207 of the Code of Criminal Procedure.

With the aforesaid observations, the revisional application being CRR 2357 of 2022 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
