Despite service, none appears for the respondents. Affidavit-of-service filed in court today be kept on record.

Since some of the respondents have refused to accept copies of the writ petition, it is deemed that good service has been effected under the law, on the respondents.

The petitioner alleges that despite the petitioner having brought to the notice of the respondent authorities serious allegations regarding the dealings of the Association of Apartment Owners with regard to the Merlin Uttara Apartment Owners' Association, no steps have been taken in that regard by the respondent authorities.

Since it would be premature to enter into a discussion on the merits of the said allegations at this stage, WPA 14387 of 2023 is disposed of by directing

respondent no.2 to immediately consider the representations made by the petitioner as annexed at pages-33 and 38 of the present writ petition and, upon giving an opportunity of hearing to the petitioner as well as to the persons against whom accusations have been levelled in the said representations, to come to a definite conclusion in accordance with law and procedure as expeditiously as possible.

The exercise shall be completed by the respondent no.2 in its entirety within two months from the date of communication of this order to the respondent no.2. The respondents and all concerned shall act on the written communication of the learned Advocate for the petitioner, accompanied by a server copy of this order, for the purpose of due compliance of the same.

It is also expected that the competent authority, that is, the respondent no.2 shall ensure that the interests of the flat owners of the said Apartment are adequately protected in the meantime.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
