Ms. Kakali Dutta Mr. Sanjoy Chakraborty ..for the petitioner Mr. Somnath Adhikary ..for Union of India In view of the stance taken by the respondents, nothing remains to be decided in this writ petition. The petitioner submits that the premises in question was leased out in favour of respondent no.2 by his mother for running a post office. The lease period has expired. The postal department is no more interested in continuing the functioning of the post office at the said premises and it has been shifted to another place.

It has been submitted by the respondents that though they are ready and willing to hand over the possession of the premises, due to some disputes between the legal heirs of the original lessee, they are not in a position to hand over the possession of the said premises.

It has been submitted before this Court that the disputes between the legal heirs of the original lessee have already been settled and the possession of the relevant premises may be handed over in favour of the petitioner.

In that view of this matter, I dispose of this writ petition with a direction upon the postal authorities to hand over the possession of the premises in question in favour of the petitioner within a period of fifteen days from date.

In view of the above directions, WPA 13310 of 2019 along with CAN 3 of 2022 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
