Commercial quantity of phensedyl mixture was recovered from the exclusive possession of the petitioner. He is in custody for about one year and two months. He prays for bail. Learned Advocate for the State says that there is sufficient incriminating material against the petitioner. July 1, 2024, has been fixed as the date for consideration of charges. In view of the restriction in Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, we are not inclined to allow the petitioner's prayer for bail, at this stage. The application being CRM (NDPS) 926 of 2024 is accordingly dismissed.

However, since the petitioner is in incarceration for over one year, the learned Trial Court is directed to definitely consider the charge on the date fixed and expedite the trial as much as possible so that the same can be concluded at an early date. Signed By :
