The petitioners being the employees of a sister concern of WBSETCL have prayed for quashing of FIR in connection with Barrackpore Women Police Station Case No.54 of 2021 dated 22nd December, 2021 presently pending before the learned Additional Chief Judicial Magistrate at Barrackpore, North-24-Parganas. On perusal of the instant revision and having heard the learned Advocate for the petitioners it is ascertained that the petitioners were entrusted to lay
the overhead electrical line through the land of one Sandhya Rani Pal. Sandhya Rani Pal demanded compensation from the WBSETCL. The said matter is under consideration by the local administration. It is alleged by the de-facto complainant that on 17th November, 2021, the accused persons came to the land of Sadhya Rani Pal to lay the overhead electrical line. The said Sandhya Rani Pal along with defacto complainant and others resisted them. Then the accused persons allegedly assaulted the complainant and others, outraged their modesty, committed extortion in furtherance of their own intention.
The matter is under investigation. If during investigation the Investigating Officer does not find any material in support of the allegation made out in the complaint, it is open for he Investigating Officer to file final report. At this stage, this Court is not in a position to admit the instant revision. If the instant revision is admitted, investigation of Barrackpore Women Police Station Case No.54 of 2021 may be hampered.
Thus, I do not find any merit in the instant revision. Accordingly the instant revision is summarily dismissed. (Bibek Chaudhuri, J.) Mithun De/ A.R. (Ct).
