The petitioner's application seeking transfer stood rejected by the Head of the Institution mentioning that he is not eligible for the same as per General Transfer Rules, 2015.

The specific reason disclosing the ineligibility of the petitioner for being transferred has not been mentioned. The unreasoned order of the Head of the Institution cannot satisfy the test of reasonableness and the principle of natural justice.

In view of the above, the rejection of the petitioner's prayer for transfer is set aside. 5.

The Head of the Institution is directed to reconsider the application afresh in accordance with the prevailing Rules for transfer at the earliest but positively within a period of eight weeks from the date of communication of this order.

Necessary consequential steps shall be taken by the Head of the Institution in accordance with law. 7.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
