of Phensydyl Syrup was recovered from the joint possession of the accused persons including the petitioner. The petitioner says that he is in custody for about 8 months and 15 days. He is an acute heart patient. He is in hospital though in custody. He prays for bail. Learned APP opposes the prayer. He says that there is direct incriminating evidence against the petitioner. Commercial quantity of contraband is involved.

Having considered the facts and circumstances of the case, we are not inclined to allow the petitioner's prayer for bail, at this stage.

CRM (NDPS) 931 of 2024 is dismissed.

However, since the petitioner has been in custody for quite some time, we direct the learned Trial court to expedite the trial and conclude the same at the earliest, without granting unnecessary adjournments and definitely within a period of a year from the date of communication of this order by the parties to the learned Trial Court. We further direct the Superintendent of Purulia Correctional Home to take all necessary steps for proper medical treatment of the petitioner. We further clarify that in the event the trial is not concluded within the time period indicated above, the petitioner will be at liberty to renew his prayer for bail.
