Petitioner is aggrieved by the fact that the directions passed upon the Officer-in-Charge, Pandua Police Station in Title Suit No.176 of 2023 were not acted upon. A representation was made to the Inspector-in-Charge, Pandua Police Station on or about 01.05.2023.

The main spirit of the accusations are that the petitioner and her mother were thrown out from their residence and are unable to enter the property. Petitioner, therefore, prayed to the police authorities for taking appropriate steps.

State has submitted a report which reflects that the statement of the petitioner was videographed wherein she was unwilling to lodge any FIR. Local enquiry was conducted and proceedings under Sections 107/116(3) of the BNSS have been drawn up

against the private respondents. Report also reflects that there is a history of dispute between the petitioner and the private respondents.

Having considered that the police authorities received the order passed by the learned civil court prior to 26th June, 2023, if any inconvenience is faced by the police authorities for implementing the learned civil court's order, police authorities will submit a report before the learned civil court. The concerned civil court will pass necessary directions relying upon the police report.

With the aforesaid observations, WPA 14430 of 2023 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
