The petitioner in WPA 4207 of 2025, namely Dwijendra Nath Pal, alleges unauthorized construction at the instance of respondent nos. 9 to 11, namely Raghunath Pal, Somnath Pal, and Narendra Nath Pal, on Plot No. 358, Mouza Monaikandra, J.L. No. 062, Khatian No. 1779, P.S. Burdwan, District Murshidabad.
Similarly, Narendra Nath Pal with one Rajkumar Pal, as petitioners in WPA 14392 of 2025,
allege that Dwijendra Nath Pal has carried out unauthorized construction on Plot No. 383 in the same locality. It appears that the petitioners in both cases are relatives and are in dispute with one another.
Learned advocate representing the State submits that the representations in both cases are pending with the Khajurna Gram Panchayat and shall be considered in accordance with law.
At this stage, I am not inclined to adjudicate upon the rival allegations. Both writ petitions are disposed of with a direction upon the Khajurna Gram Panchayat, District Murshidabad, to consider the representations of the respective parties and take necessary action in terms of Section 23(5) of the West Bengal Panchayat Act, 1973, after giving an opportunity of hearing to all concerned.
The exercise shall be completed within three months from the date of communication of this order.
Accordingly, writ petitions being WPA 4207 of 2025 and WPA 14392 of 2025 are disposed of. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
