05.07.2023 sdas rejected C.R.M. (NDPS) No. 1173 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Habibpur Police Station Case No. 398 of 2022 dated 13.12.2022 under Section 23 of the NDPS Act.

And In Re : Ranjit Mandal ..... petitioner Mr. Sarjati Dutta Ms. Sanjana Saha Sk. Sahil Ahad ... for the petitioner Mr. Antarikhya Basu ... for the State Learned Counsel for the petitioner submits he is in custody for 148 days. It is also submitted that he has been falsely implicated. He prays for bail.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Initially a consignment of phensedyl syrup was recovered. Petitioner and co-accused had fled from the spot. Upon his arrest, on the leading statement of the petitioner another cache of phensedyl syrup was recovered. In view of the aforesaid materials we are of the opinion this is not a fit case to grant bail to the petitioner. The application for bail is, thus, rejected.
