The limited grievance of the petitioner is that, despite having given several representations to the distribution company regarding hooking from the electric meter of the petitioner for the operation of an illegal submersible pump within meters from the petitioner's submersible pump at the behest of the private respondents, the respondent authorities have not taken any steps in that regard.

Learned counsel appearing for the distribution company submits that the scope of the representations may go beyond the authority of the distribution company to decide.

However, despite service, none appears on behalf of the private respondents.

Affidavit-of-service filed in court today, be kept on record.

In view of the above circumstances, WPA 15227 of 2021 is disposed of, thereby directing respondent nos.2 and 4 to consider the representations given by the writ petitioner, as annexed to the present writ petition, with liberty to the petitioner to file a fresh representation in addition as well, within four weeks from the date of filing of the additional representation, if any.

In the event such additional representation is not filed within a fortnight from date, the respondent no.4 shall proceed to decide on the representations annexed to the present writ petition independently in accordance with law within four weeks from the expiry of a fortnight from date, that is, within six weeks from date. It will be open to the respondent no. 4 to determine the question as to whether and/or how far the said respondent has authority in law to decide on the representations as well.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
