02.9.2025 akb Sl. 258 Ct.29 Rejected CRM (NDPS) No. 798 of 2025 In re: An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with the TR Case No. 20 of 2024 arising out of Sankrail Police Station Case No. 742 of 2024 dated 27.09.2024 under Section 21(c)/29 and adding Section 22(c) of the NDPS Act, 1985.

And In re: Pawan Jaiswal ... petitioner Mr. Minhaz Serweny Islam ...for the petitioner Mr. Kunal Ganguly ...for the State Prosecution case is that leading statement of the present petitioner 100 bottles of cough syrup containing codeine phosphate was recovered from his possession and he was arrested on 25th November, 2024.

Learned Counsel appearing on behalf of the petitioner submits that the other co-accused persons have been already granted bail being the associate of valid licence holder and he is almost on the same footing and as such he may also be granted bail. He further submits that the petitioner has been described as an associate of Advance Health Care Unit, who has a valid licence. Learned Counsel appearing on behalf of the State submits that the bail prayer of the petitioner was rejected on 24th April, 2025 after considering all the submissions of the present petitioner and no new circumstances has arisen to reconsider the same. Having heard learned Counsel for the petitioner and the State and that the commercial quantity of Narcotic substance was recovered from the possession of the present petitioner and that his bail prayer was rejected on 24th April, 2025 with a direction upon trial Court to conclude trial within a time frame and no new circumstances has

arisen since then to reconsider his prayer, I find no substance in the petitioner's contention and as such the prayer for bail is considered and rejected.

The application, being CRM (NDPS) 798 of 2025 is accordingly disposed of.
