Learned advocate for the State has submitted that Uttarpara P.S. Case No. 296 of 2024 dated 24.07.2024 has been registered for investigation under the relevant provisions of IPC.

Having considered the prayers so advanced by the petitioner, I am of the view that, primarily, the grievance of the petitioner has been addressed.

Learned advocate for the respondent nos. 9 and 10 is present.

The petitioner is also aggrieved by the mode and manner of investigation which has been carried out and the sections which have been incorporated are against the settled propositions of law and the factual foundation as laid down in the case.

In view of the grievance of the petitioner and the fact that the jurisdictional criminal court is in seisin of the matter, where, charge-sheet has been submitted by the investigating agency, I grant liberty to the petitioner to approach the jurisdictional court by way of taking out appropriate application under the

relevant provisions of Section 193(9) of the BNSS.

With the aforesaid observations, WPA 15424 of 2024 is disposed of.

Let Photostat copy of the order passed by the ld. ACJM, Serampore and FIR as submitted by the petitioner be kept with the record.
