Report filed on behalf of the State is taken on record. Heard the learned counsels for the parties.
Perused the case diary.
It appears that the person from whom the truck was seized could not be traced out for examination. However, there is statement of one Mir Shakeel who ran the transport business and took vehicles from others. He stated that the petitioner and two others were known to him in connection with such transport business. He further stated that there are earlier instances of goods being stolen away when these persons were involved in transport of such goods.
Considering the above and the other incriminating materials available in the case diary including the statement of a witness present at page 50 of the case diary, I do not consider this to be a fit case for granting anticipatory bail to the petitioner.
The application for anticipatory bail being C.R.M. (A) 2218 of 2025 is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
